Terms of Service

These terms are the contract between you and Daria’s publisher: what Daria does, what you agree to do, and what the law guarantees you.

This document is published in French and English. The French version is the original. The English version is a translation: where the two differ, the French version applies.

The service and these terms

Daria is a service for tabletop roleplaying campaigns: a Discord bot that records and transcribes your sessions and makes summaries and media from them, the web app at app.daria.gg, the MCP server at mcp.daria.gg, a Foundry VTT module, and this site. It is published by Maxime Bertheau, Sole trader (entrepreneur individuel, EI), 2 Place Jean V, Bureau 3, 44000 Nantes, France (SIREN 130 516 255, RCS Nantes) — “we” in these terms. To write to us: hello@daria.gg.

You accept these terms when you add Daria to a Discord server, when you sign in to the web app, or when you authorise an AI client to read a campaign through the MCP server. Being recorded at a table where Daria is present commits you to nothing; the privacy policy says what happens to your data.

Daria’s software, site, name and logo belong to us: these terms give you the right to use Daria for your games, and no other.

Who can use Daria

You must be at least 13 to use Daria, or older if the law of your country or the services through which you use Daria require it. Subscriptions and purchases are for adults, or for younger people with a parent’s or guardian’s permission.

Recording and consent

If you record or import a session, you agree:

to tell everyone being recorded before you start;
never to record someone who objects, nor to import a recording they are in;
to record a minor only with their parents’ agreement.

Your content

What you give Daria stays yours, and we claim no ownership of what Daria makes for your campaign. You must have the right to give Daria what you put in.

You grant us a non-exclusive, free, worldwide licence over that content, and over what Daria makes from it, for as long as it is kept, which only lets us: store it, transcribe it, summarise it and make media from it to provide the service; have our providers process it; show it to the members of the Discord server that hosts the campaign and, within what a link shows without signing in, to anyone who holds that link; use it to improve Daria; and show the media Daria generates, to present the service, provided they contain no personal data and you have not objected. Rules of use and reports

You may not use Daria for content that is illegal, under French law or under the law of the country you are in, to harass or threaten real people, for sexual content involving a minor, real or fictional, or to infringe anyone’s rights; nor try to reach what is not open to you, get around Daria’s limits or disrupt how it works. The fiction of your games can be dark: these rules are about what is illegal or harms real people.

To report content you believe is illegal, whether or not you use Daria, write to hello@daria.gg saying why it is illegal, where it is, your name and email address — unless it concerns the sexual abuse of a child — and that your report is made in good faith. We review every report and tell you what we decide.

The providers that generate text and media apply their own automated filters and may refuse a request. Any other measure, such as removing content or suspending Daria, is decided by a person, who gives you the reasons and tells you how to contest it.

What the AI produces

What Daria produces with AI — transcripts, summaries, answers, media — can be wrong or incomplete. Check what matters: you are responsible for how you use it.

Subscriptions and purchases

The subscriptions and one-off purchases Daria offers, such as generating a character’s portrait, are made through a payment service, which collects the payment. Cancelling a subscription and having a purchase refunded are possible free of charge, under that payment service’s terms (for Discord, its Paid Services Terms and Refund Policy).

What you bought is provided by Daria, under these terms. For any problem with it, write to us at hello@daria.gg: we will look at each request case by case.

Legal guarantee of conformity (the official wording is the French)

The consumer is entitled to have the legal guarantee of conformity applied when a lack of conformity appears within a period covering the whole time the service is supplied, counted from the supply of the digital content or digital service. During that period, the consumer only has to establish that the lack of conformity exists, not the date on which it appeared.

The legal guarantee of conformity entails the obligation to supply every update needed to keep the digital content or digital service in conformity for the whole time the service is supplied.

The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay after their request, free of charge and without significant inconvenience to them.

The consumer may obtain a price reduction while keeping the digital content or digital service, or may end the contract and be refunded in full in return for giving up the digital content or digital service, if:

1° the trader refuses to bring the digital content or digital service into conformity;
2° bringing the digital content or digital service into conformity is unjustifiably delayed;
3° the digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
4° bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;
5° the lack of conformity of the digital content or digital service persists despite the trader’s unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a price reduction or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer then does not have to ask for the digital content or digital service to be brought into conformity first.

Where the lack of conformity is minor, the consumer is entitled to have the contract cancelled only if the contract does not provide for the payment of a price.

Any period during which the digital content or digital service is unavailable while it is being brought back into conformity suspends the guarantee for the time it still had to run, until the digital content or digital service is supplied in conformity again.

These rights result from Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.

A trader who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).

The consumer also has the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in return for giving up the digital content or digital service.

Duration and suspension

These terms apply for as long as you use Daria, and you can leave at any time, free of charge. Removing Daria from a server does not delete what Daria has kept: for that, write to us at hello@daria.gg.

If you seriously break these terms, we may suspend Daria for you or for the server concerned, telling you why and how to contest the decision (Rules of use and reports).

Liability

If you use Daria for your business, then except for gross negligence or wilful misconduct on our part, or bodily injury, we are not liable for indirect loss, and our total liability is capped at the higher of these two amounts: what you paid for Daria in the twelve months before the event giving rise to it, or 100 euros.

Changes

Daria evolves. We may change the service for a valid reason, such as improving it or complying with the law, at no extra cost to you and under Article L. 224-25-26 of the French Consumer Code: if a change has a negative impact, and not a minor one, on your access to Daria or on how you use it, you can terminate free of charge within 30 days.

These terms can change too. Each version is dated at the top of this page and announced, with its effective date, in Daria’s community server on Discord; if you do not accept it, you can stop using Daria.

Governing law and disputes

These terms are governed by French law. If you are a consumer living in another country, you keep the protection that the mandatory provisions of that country’s law give you.

If we disagree, you can write to us first at hello@daria.gg: we will look for an amicable solution with you. If you are a consumer and that exchange does not settle it, you can refer the dispute, free of charge, to the consumer mediator we belong to: Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C), 49 Rue de Ponthieu, 75008 Paris, France (file a request online). To do so, you must first have sent us a written complaint, and refer the dispute to the mediator within a year of it.

If you are a consumer, you may bring proceedings before the courts of the country where you live, or before the French courts. If you use Daria for your professional activity, the French courts have sole jurisdiction.
